Knowledge, Training and Experience
Solicitor or Barrister with between 2 – 5 years PQE
Educated to masters level or equivalent level of experience of working at a senior level in specialist area.
Detailed knowledge and practical application of the following areas of English law to at least degree level in at least 3 of the
Contract law, Mental Health Act, Data, Corporate Governance, Medical law, NHS law and Human Rights.
Evidence of post qualifying and continuing professional development
Must have an understanding of the background to and aims of current healthcare policy and appreciate the implications of this on engagement
for delivering key messages to a range of stakeholders both internal and external to the organisation, some at very senior level.
Good presentational skills for conveying complex concepts.
Ability to use informed persuasion to influence others.
Ability to identify risks, anticipate issues and create solutions and to resolve problems in relation to project or service delivery.
Ability to understand a broad range of complex information quickly and making decisions where opinions differ/no obvious solution
Evidence of planning and delivering projects and legal services on time.
Abilities for financial and staff management

Non Contentious healthcare
Public law issues – advice on powers and duties, constitutional issues, clinical and corporate governance and assurance and challenges by way of judicial review,
Information law – application of and information governance issues.
Advising on performers lists, primary care contracting regulations and CQC issues, serious incidents and supporting inquiries, providing support in relation to inspections
Patient issues – DOLS, continuing healthcare, funding of treatment and consent issues, Court of Protection proceedings, best interest cases, discharge of patients, s.117 aftercare, planning and provision of services
Mental health law advice - including challenges by way of judicial review and under the Human Rights Act 1998
Policies – review and advising on the formation of policies
Contractual claims relating to standard form of contract with various providers, including claims for over-payment, breach and associated appeals and any hearings before the FHSAU or courts.
Performers lists and PLDP disputes including any judicial reviews and appeals.
Claims and Inquests – defendant clinical negligence claims, property and third party claims, including liaison with the NHSLA and their panel firms.
Judicial review including pre action challenges and advising on mitigation steps.
Key Working Relationships

3. Functional Responsibilities
As responsible legal advisor lead working internally and externally to deliver projects, initiatives and services to time and in a cost effective way.
To support the identification and sharing of best practice in understanding legal risk and engaging clients accordingly.
To operate in a highly political and sensitive environment.
3.2 Financial and Physical Resources
Responsible for managing any legal matter budget and for ensuring that the budget breaks even. Co-ordinate the budget, monitoring expenditure against target areas.
Responsible for supporting the commissioning of external legal advice and supervising its delivery.
Provide financial reports to the Head of Legal Services as required.
Provide advice and prepare strategic reports and briefings for directors and stakeholders.
In depth analysis, interpretation and production of complex and multiple matter reports.
Act in a way that is compliant with Standing Orders and Standing Financial Instructions in the discharge of this responsibility.
Constantly strive for value for money and greater efficiency in the use of these legal budgets and identify opportunities to make savings year on year.
3.3 Staff Management
Assisting with the day to day supervision of junior team members, which will include responsibility for supporting development of staff, recruitment and where necessary processes such as grievance and disciplinary matters.
Responsible for an individual’s development on the job and job performance management. Work in conjunction with line managers and other job managers to assess and manage confidential information about an individual’s performance and capability development.
3.4 Information Management.
Develop the acquisition, organisation, provision and use of knowledge and information.
Highlight exceptions and risks ensuring mitigating action can be taken to keep the caseload on track.
Drafting reports summarising status on issues, appraising outcomes, and providing progress reports for the Head of Department.
Collate as required, qualitative and quantitative information and lead appropriate analysis to develop robust business cases and contribute to project ‘products’.
Analyse, interpret and present data to highlight issues, risks and support decision making.
Planning and Organisation
Assist with the development and implementation of the legal strategy and service development.
Support the development and implementation of strategies for improving performance
Deliver the development and improvement of processes.
Ensure stakeholder representation is engaged throughout the cycle.
Deliver process efficiency in the continuous development of the end-to-end cycle and its associated performance metrics.
Accountable for delivery of own objectives in line with the team’s short, medium and long term business plans, achieving quality outcomes.
Identify and liaise with all stakeholders whom you should work with to deliver the above and manage other inter-dependencies.
Monitor and manage the advice given to the organisation and identifies trends and consistent issues.
Responsible for advising on all healthcare law matters and act on behalf of the organisation in legal proceedings.
Demonstrate a sound understanding of the business and builds strong relations with internal clients in order to champion, prioritise and embed appropriate legal advice.
Consider the feedback and experience of Directorates and use this to influence the direction on Legal priorities and the application of legal guidance for operations.
Continuous review and improvement of the quality of own output and processes against specific objectives, contributing to the embedding of a quality culture across the whole organisation.
